Workers' Compensation

Injuries caused by workplace accidents can be costly to treat. This is especially a problem for workers who require time off to recover. Right when their wages have been cut, they are suddenly met with staggering medical bills and no paycheck on top of it. If you are in this situation, you are probably wondering about types of assistance that are available to you.

What is workers' compensation?
The workers’ compensation laws are designed to protect injured employees, regardless of fault. These benefits include medical care, lost wages and benefits for permanent impairment from injuries.

An injured worker may not “sue” an Employer for damages, as in a car accident, but may file a claim for benefits and appear in front of an Administrative Law Judge if the insurance company does not pay for benefits the injured worker may be entitled to.

What is the next step?
The insurance company responsible for paying your benefits will not tell you what your rights are or what other benefits you may be entitled to. At the Law Firm of Joanna Jensen, our focus is to get you back on track with life. With the knowledge and experience that comes from representing hundreds of injured workers over the years, we understand the proper steps to take. Did you know?

It is your responsibility to give your employer WRITTEN notice within 4 days of a workers' compensation injury, even if they saw you get hurt. However, even if written notice is not given within that time period, you may still be entitled to benefits under the workers' compensation laws. Upon notice that you have been injured and wish to seek medical treatment, your employer must provide you the name of two doctors you may see to treat your injuries. If they do not, you may choose your own doctor. Within 90 days of a workers' compensation injury, you may request to change doctors if you are not happy with the medical treatment you are receiving.
